GENERAL CONDITIONS OF SALE
ARTICLE 1 – DEFINITIONS
These General Terms and Conditions of Sale (hereinafter the “GTC”) are offered by the company Preserve Biz Inc. , registered under number (to be specified) and whose head office is located at 7-5020 Avenue Saint-Kévin, Montreal, QC H3W 1P4, Canada (hereinafter “ Vital Actif ”).
We will subsequently designate:
- “Site” : the site “ https://vitalactif.com ” and all of its pages, exclusive property of the Company.
- “Products” or “Services” : all products (materials) and services (benefits) that can be purchased or subscribed to on the Site.
- “Seller” : Vital Actif , legal or natural person, offering its Products or Services on the Site.
- “Customer” : the Internet user, individual or professional, making a purchase of Product(s) or Service(s) on the Site.
- “Consumer” : in accordance with the definition of the preliminary article of the Consumer Code, “any natural person who acts for purposes which do not fall within the scope of his commercial, industrial, craft or liberal activity.”
The Internet user visiting the Site and interested in the Products and Services offered by the Seller is invited to read these T&Cs carefully, to print them and/or to save them on a durable medium, before placing an order on the Site.
The Customer acknowledges having read the General Terms and Conditions and accepts them in full.
ARTICLE 2 – APPLICATION OF THE GTC AND PURPOSE OF THE SITE
The Seller reserves the right to modify the T&Cs at any time by publishing a new version of the latter on the Site.
The General Terms and Conditions applicable to the Customer are those in force on the day of the order on the Site.
This Site offers the online sale of functional bodybuilding products, health advice, ebooks and related accessories.
The Site is freely accessible and free of charge to any Customer. The acquisition of a Product or a Service implies acceptance by the Customer of all of these General Terms and Conditions. This acceptance may consist, for example, for the Customer, in checking a box corresponding to the acceptance of these General Terms and Conditions.
ARTICLE 3 – CUSTOMER SERVICE

ARTICLE 4 – ORDERING TERMS AND PURCHASING PROCESS
The Products offered are those that appear in the catalog published on the Site. Each Product is accompanied by a description. The photos on the Site are not contractual and may vary from the models photographed due to screen settings.
To order:
- Select one or more Products and add them to the “Cart” .
- Check the order details on the “Cart” page.
- Provide your contact information on the “Information” page.
- Choose a shipping method on the “Shipping” page.
- Complete your order on the “Confirmation” page after entering your bank details and, if applicable, a promotional code.
ARTICLE 5 – PRICE AND PAYMENT TERMS
The prices indicated are expressed in euros (€) and include all taxes. The Customer can pay for their orders by credit card, PayPal, or other methods available on the Site. Transactions are secured via a certified payment provider.
The Seller reserves the right to modify its prices at any time, but the applicable price is that indicated at the time of the order.
ARTICLE 6 – DELIVERY
The Site delivers internationally. Delivery costs are indicated at the time of ordering. Delivery times are given for information purposes only and may be modified in the event of force majeure or delays in postal services.
ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with the regulations, the Customer has 14 days to return an unused Product, in its original packaging, at his own expense, for reimbursement or exchange.
ARTICLE 8 – PRODUCT WARRANTY
The Products benefit from legal guarantees of conformity and against hidden defects.
ARTICLE 9 – INTELLECTUAL PROPERTY
All contents of the Site (texts, images, logos) are protected by intellectual property law. Any reproduction is prohibited without the prior written permission of Vital Actif .
ARTICLE 10 – PROCESSING OF PERSONAL DATA
The data collected on the Site is used for processing orders and improving services. It is stored in accordance with the General Data Protection Regulation (GDPR). The Customer may exercise his rights at any time by contacting contact@vitalactif.com .
ARTICLE 11 – SMS POLICY
By accepting SMS marketing, the Customer consents to receive notifications and offers related to their orders. To unsubscribe, send “STOP” in response to a message received or contact us at contact@vitalactif.com .
ARTICLE 12 – APPLICABLE LAW AND MEDIATION
In the event of a dispute, French law applies. Mediation is available to resolve disputes amicably.
